1. Introduction
These Terms of Service ("Terms") govern access to and use of Hoskes Cloud ("Service"), operated by HOSKES DESENVOLVIMENTO DE SISTEMAS LTDA ("Hoskes", "we", "us"), CNPJ 53.371.345/0001-18, with operations at São Paulo, SP, Brazil.
By creating an account, connecting GitHub or Google, using our MCP integration, or deploying a project, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Hoskes Cloud is a cloud runtime platform that builds and runs Docker containers from your GitHub repositories, provides HTTPS URLs on *.cloud.hoskes.com, and supports deployment via MCP-compatible AI agents.
Features may include project hosting, build logs, environment variables, team collaboration, managed databases on paid plans, and API access. We may add, change, or remove features at any time.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the security of your account credentials, API keys, and OAuth connections.
You must provide accurate registration information and notify us of unauthorized access at support@hoskes.cloud.
4. Plans and usage limits
We offer Free and paid plans (e.g. Starter) with different project limits and resources. Current limits are described on our Pricing page and may change with notice.
You may not circumvent plan limits, abuse free tiers, or use the Service in a way that degrades performance for other users.
5. Acceptable use
You must comply with our Acceptable Use Policy. You are solely responsible for content, code, and applications you deploy. We may suspend or terminate accounts that violate applicable law or our policies.
6. GitHub and third-party integrations
When you link GitHub, you authorize us to access repositories per the OAuth scopes you approve (including private repos when applicable). You remain subject to GitHub's terms.
Third-party services (Google, GitHub, Stripe) have their own terms. We are not responsible for third-party outages or policy changes.
7. Your content and intellectual property
You retain ownership of your code and data. You grant Hoskes a limited license to host, copy, and process your content solely to provide the Service.
Our platform, brand, documentation, and software are owned by Hoskes and protected by intellectual property laws.
8. Availability and modifications
We strive for high availability but do not guarantee uninterrupted service. Maintenance, updates, and incidents may cause downtime.
We may modify or discontinue the Service or these Terms. Material changes will be communicated via the website or email. Continued use after changes constitutes acceptance.
9. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
To the maximum extent permitted by law, Hoskes shall not be liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill. Our aggregate liability shall not exceed the fees you paid to Hoskes in the twelve months preceding the claim, or USD $100 if you use the Free plan.
10. Indemnification
You agree to indemnify and hold Hoskes harmless from claims arising from your use of the Service, your deployed applications, violation of these Terms, or infringement of third-party rights.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your account for violations, non-payment, or risk to the platform.
Upon termination, your right to use the Service ends. We may delete project data after a reasonable retention period, subject to legal obligations.
12. Governing law
These Terms are governed by the laws of Brazil. Disputes shall be submitted to the courts of São Paulo, SP, Brazil, unless mandatory consumer protection law provides otherwise.
